Criminal justice reform activists say that New York’s new bail reform law was long overdue. But critics argue that it has gone too far. One of its most vocal opponents, New York Assemblywoman Nicole Malliotakis, says that, “if it doesn’t get fixed, there’s going to be blood on Governor Cuomo’s hands.” She’ll share her take on the controversial legislation and discuss her efforts to unseat Democratic Congressman Max Rose.

THAT LAW HAS BEEN UNDER TOUGH
SCRUTINY SINCE IT WAS
IMPLEMENTED ON JANUARY 1st.
NYPD COMMISSIONER SHEA BELIEVES
THAT IT IS REQUIRES THE RELEASE
OF ALL SUSPECTS EXCEPT THOSE
CHARGED WITH THE MOST VIOLENT
SKRIMS RESPONSIBLE FOR A QUOTE,
SIGNIFICANT UP TICK OF CRIME IN
THE CITY.
ACCORDING TO THE COMMISSIONER,
IN THE FIRST THREE WEEKS OF
2020, OVERALL CRIME INCIDENTS
ROSE BY 11% INCLUDING A 32%
INCREASE IN ROBBERIES, A 61%
INCREASE IN CAR THEFTS, AND AN
18% INCREASE IN BURGLARIES
COMPARED TO THE SAME PERIOD LAST
YEAR.
NOW ALONG WITH A NUMBER OF OTHER
LAW ENFORCEMENT OFFICIALS ACROSS
THE STATE, HE HE IS CALLING FOR
THE LAW TO BE AMENDED.
ONE IS TO DECIDE WHETHER OR NOT
TO KEEP THEM BEHIND BARS.
A SYSTEM THAT CRITICS SAY HAS
BEEN SUCCESSFULLY IMPLEMENTED IN
NEW JERSEY AND OTHER STATES.
MANY CRIMINAL JUSTICE REFORM
ADVOCATES ARGUE THAT GIVING
JUDGES DISCRETION IS
UNACCEPTABLE AND IT IS SIMPLY
TOO EARLY TO DECLARE THE NEW LAW
A FAILURE.
THE ASSEMBLY WOMAN WHO IS
LOOKING TO UNSEAT MAX ROSE IN

SESSION AND NOBODY HAS DONE
ANYTHING TO ADDRESS IT AND IT
HAS BEEN US, THE REPUBLICANS,
PUTTING FORWARD LEGISLATION FOR
FIXES.
AND I HAVE TO TELL YOU, IF IT
DOESN'T GET FIXED THERE WILL BE
BLOOD ON GOVERNOR CUOMO'S HANDS.

>> WE DID SEE SOMEONE ON
THANKSGIVING WHO WAS RELEASED
WITH NO BAIL, CAME BACK AND
KILLED A 92-YEAR-OLD WOMAN ON
THE STREETS OF QUEENS.
THAT'S ONE EXAMPLE WHEN DO YOU
RELEASE PEOPLE WITHOUT BAIL,
WHAT CAN HAPPEN IF THEY POSE A
DANGER TO SOCIETY.
IN ROCKLAND COUNTY ON CHRISTMAS
EVE, THERE WAS A YOUNG MOTHER OF
THREE WHO WAS HIT BY A VEHICLE
IN A FATAL HIT AND RUN.
SHE WAS KILLED, UNFORTUNATELY.
THIS WAS AN UNLICENSED DRIVER,
FLED THE SCENE, HE WAS CAUGHT,
ARRESTED AND RELEASED BACK ON TO
THE STREET.
AND WE SAW A DRUNK DRIVER,
SOMEBODY WHO HAD 12 CONVICTIONS,
SIX FELONIES, SIX MISDEMEANORS,
DIDN'T SHOW UP FOR COURT IN FIVE
PREVIOUS CASES.
HE WAS ARRESTED FOR NOT
COMPLYING WITH THE COURT ORDER
INTERLOCK DEVICE.
HE WAS RELEASED, KILLED SOMEONE
A COUPLE WEEKS LATER DRIVING
DRUNK AND THEN WAS RELEASED
AGAIN.
THAT IS PRETTY OUTRAGEOUS AND
THAT IS WHAT THIS LAW ALLOWS.
THERE ARE A LOT OF FLAWS AND I
THINK THERE IS A GOOD GOAL HERE
OF ENSURING, NUMBER ONE,
EVERYONE GETS THEIR PROTECTED
RIGHT TO A SPEEDY TRIAL.
WE CAN ACHIEVE THAT.
WE DON'T HAVE TO JUST THROW OUT
BAIL.
YOU CAN HAVE A NO CASH BAIL
SYSTEM FOR FIRST TIME OFFENDERS,
LOW LEVEL OFFENDERS.
SOME OF THE CRIMES RATHER
DISTURBING.
VIOLENT CRIMES LIKE
STRANGULATION, ASSAULT,
AGGRAVATED ASSAULT OF A CHILD,
SOME PROSTITUTION OF A CHILD,
VEHICULAR MANSLAUGHTER,
HOMICIDE, THESE ARE CRIMES THAT
ARE ELIGIBLE FOR THIS.
AND I THINK THAT IS A MAJOR
PROBLEM.
TO BE RELEASED WITH NO BAIL AND
THAT IS A MAJOR ISSUE.
WHAT WE WANT TO SEE IS JUDICIAL
DISCRETION RESTORED.
WE WANT TO ENSURE THAT
DANGEROUSNESS IS CONSIDERED OF
THE.
>> I WANT YOU TO LATER IN THE
CONVERSATION, GIVE US YOUR
BULLET POINTS OF REFORMS THAT
WOULD YOU LIKE TO SEE.
LET'S STAY ON THIS FOR ONE
SECOND OF THE AS YOU KNOW, IN
THE DECADES BEFORE THIS NEW LAW
WENT INTO EFFECT, JUDGES HAD THE
DISCRETION OF LETTING BAIL ANYW.
AND THEY DID LET OUT THOUSANDS
AND THOUSANDS OF PEOPLE OUT
WITHOUT BAIL.
PEOPLE WHO HAD COMMITTED
MISDEMEANORS, NONVIOLENT
FELONIES AND EVEN VIOLENT
FELONIES AND A LOT OF THEM WENT
OUT COMMITTING VERY BAD CRIMES,
VERY SIMILAR TO THE ONES YOU
JUST DESCRIBED.
YET THOSE NEVER GOT THE LEVEL OF
ATTENTION BY THE PRESS OR BY
ELECTED OFFICIALS THAT THESE
RECENT CASES DID.
I WONDER WHY.
>> I ACTUALLY HAD BEEN TALKING
ABOUT THAT ISSUE BEFORE THE BAIL
LAW HAD PASSED.
AND I THINK THAT'S AN ISSUE OF
VERY LIBERAL JUDGES WHO ARE JUST
RELEASING PEOPLE.
THAT'S UNFORTUNATE.
PEOPLE HAVE TO UNDERSTAND THAT
THEY EITHER ELECT THOSE JUDGES.
ANY OF THEM ARE ELECTED TO THE
CIVIL COURT AND THEN SIT ON
CRIMINAL COURT OR THEIR IS
APPOINTING THEM.
SO SOME OF THE EXAMPLES THAT
WE'VE USED IN THE PAST, PEOPLE
BEING RELEASED, THEY WERE
APPOINTED BY MAYOR de BLASIO.
IN SOME CASES HE'S REAPPOINTED
THEM EVEN AFTER OUTRAGE.
THERE WERE CASES WHERE PEOPLE
WHO THREATENED TO KILL POLICE
OFFICERS WERE RELEASED WITHOUT
BAIL.
AND THIS MAYOR CAME SXLAPG
REAPPOINTED THEM.
OR THEY WERE ON THE BALLOT AND
PEOPLE REELECTED THEM.
SO PEOPLE NEED TO PAY ATTENTION
TO HOW THESE JUDGES AND OUR
LEGISLATORS VOTE AND HOW THE
JUDGES ACT ON SOME OF THESE
CASES.
IF YOU DISAGREE WITH THAT, YOU
NEED TO GET OUT TO THE POLLS.
>> I HEARD SOMEBODY STAY OTHER
DAY, WE LOSE SIGHT OF THE FACT
BAIL WAS NEVER INTENDED TO
PUNISH ANYBODY.
IT WAS ALWAYS INTENDED SIMPLY TO
MAKE SURE THAT DEFENDANTS SHOWED
UP TO THEIR TRIALS BUT IT HAS
BECOME IN ESSENCE, A VIOLATION
OF THE ESSENTIAL BASIS OF OUR
LEGAL SYSTEM, INNOCENT UNTIL
PROVEN GUILTY.
THESE PEOPLE ARE IN JAIL BECAUSE
THEY CAN'T MAKE THEIR BAIL BUT
THEY'RE BEING PUNISHED FOR
CRIMES THEY HAVE YET TO BE FOUND
GUILTY OF.
>> THAT WAS I THINK THE GOAL AND
INTENTION OF THIS LAW.
THEY WENT WAY TOO FAR AND THEY
TOOK AWAY JUDICIAL DISCRETION,
EVEN IN A SITUATION.
WE NEVER BASED ON IT
DANGEROUSNESS.
WE ALWAYS BASED IT ON WHETHER
YOU'RE RETURNING TO COURT.
OTHERS HAVE SAID, IF YOU ARE A
DANGER TO SHOW.
IF YOU HAVE A CRIMINAL ACTIVITY
OF VIOLENCE, YOU WON'T BE
ELIGIBLE FOR SUCH A PROGRAM.
IF YOU ARE A FIRST TIME
OFFENDER, A LOW LEVEL OFFENSE.
NONVIOLENT.
THAT'S SOMETHING THAT SHOULD BE
CONSIDERED AND WE CAN ELIMINATE
THE BAIL.
YOU WON'T DO IT FOR SOMEONE WHO
HAS MULTIPLE CONVICTIONS.
24 PRIOR ARRESTS.
A PROTECTIVE POLICE OFFICER,
RELEASED WITH NO BAIL.
BACK ON THE STREET AND IN SOME
CASES, THEY'RE REARRESTED THE
SAME WEEK.
SHOW THAT IS THE POINT THAT OUR
POLICE COMMISSIONER WAS MAKING.
NUMBER ONE, PEOPLE WHO ARE
REPEAT OFFENDERS IN THE SAME
WEEK OR TWO WEEKS, COMMITTING
MULTIPLE CRIMES AND BEING
RERELEASED OVER AND OVER AGAIN.
THE OTHER ISSUE OF JUST MAKING
SURE THAT THE PEOPLE ARE
UNDERSTANDING THAT THIS IS NOT A
FREE FOR ALL.
YOU CAN'T JUST, I THINK WHAT IS
GOING ON IS THAT THE MAYOR AND
THE GOVERNOR CREATE AN
ENVIRONMENT OF LAWLESSNESS.
>> TO GIVE THE MAYOR'S DUE,
DIDN'T HE FROM THE BEGINNING
WANT THE REFORMS INCLUDE
JUDICIAL DISCRETION?
>> I DON'T KNOW ABOUT FROM THE
BEGINNING.
HE HAD SAID WE'LL GET PEOPLE
METS TICKETS TO INCENTIVIZE THEM
TO RETURN TO COURT.
>> THE GOVERNOR ACTUALLY DID.

GIVE THE MAYOR CREDIT.
EVEN HE IS SAYING, THIS TOOGS

THEY HAVE TO CONSIDER AN
INDIVIDUAL'S PUBLIC SAFETY
THREAT.

FOR NO ONE NOW.
JUDGES DO HAVE DISCRETION AND
THAT'S WHAT A LOT OF THE PEOPLE
SAY IT SHOULD BE AMENDED TO.
BUT ADVOCATES OF JUDICIAL REFORM
SAY THIS IS EXACTLY WHAT WE
DON'T WANT.
TO ADD SUBJECTIVITY TO THE
PROCESS.
BECAUSE THEY SAY IF PAST IS
PROLOGUE, JUDGES WILL ATTEMPT TO
SEE POOR PEOPLE, OF COLOR,
BLACKS AND LATINOS AS
AUTOMATICALLY MORE DANGEROUS
BECAUSE THAT'S WHAT'S HAPPENED
IN THE PAST.
HOW DO YOU RESPOND?

JUDGES AND GIVE THEM AUTHORITY.
THAT'S WHY WE HAVE SEPARATE
BRANCHES OF GOVERNMENT, BUT
NUMBER TWO, THERE ARE CERTAIN
CASES THAT CAN BE PLACED IN THE
LAW.
LIMITING THE TIMES OF CRIMES.
WE CAN TIGHTEN THIS LIST SO WE
ELIMINATE ASSAULT AND AGGRAVATED
ASSAULT, VEHICULAR MANSLAUGHTER,
HOMICIDE, WE CAN REMOVE THAT
WHICH IS CURRENTLY PART OF
OPPORTUNITY TO BE RELEASED WITH
NO BAIL.
WE CAN TIGHTEN THE LIST.
BUT YOU CAN ALSO SAY, LOOK,

RESTRICTING THE LIST OF CRIMES,
ENSURING WE'RE PROTECTING
WITNESSES, AND MORE IMPORTANTLY
IN ACHIEVING THE GOAL THAT WE
ENSURE EVERYONE GETS THEIR
CONSTITUTIONALLY PROTECTED RIGHT
TO A SPEEDY TRIAL WHICH THIS
DOES NOTHING TO ADDRESS.
WE COULD BE INVESTING RESOURCES
IN OUR COURT SYSTEM TO MAKE SURE
THE CASES ARE HEARD QUICKER.
THEY NEED COURT OFFICERS, COURT
REPORTERS, JUDGES TO DO THAT.

I THINK IT IS VERY IMPORTANT.

BUDGET ADDRESS, SAID THAT HE'S
OPEN TO CHANGES.
THAT HE BELIEVES SOME REFORMS
NEED TO BE MADE.
THE MAYOR HAS COME OUT.
MEMBERS OF CONGRESS LIKE MY
OPPONENT, MAFL ROSE, WHO WAS
SUPPORTIVE OF THE BAIL REFORM IS
TRYING TO BACKTRACK AS WELL.
WE'RE GAINING A LOT OF MOMENTUM
IN GETTING PEOPLE WHO SUPPORTED
THIS BAIL REFORM TO NOW REVERSE
TRACK.
AND I THINK THAT IS CRITICAL.
WE CAN'T DO IT ALONE.
WE DON'T HAVE THE VOTES IN THE
STATE LEGISLATURE.
WE NEED THE GOVERNOR TO SIGN OFF
ON IT.
THE BIGGEST OBSTACLE IS THE
SPEAKER.

MISTREATED BY GOVERNMENT.
AND THEY WANT SOMEONE WHO WILL
REPRESENT THEIR VALUES AND BE A
COUNTER BALANCE, BY THE WAY, IN
THE CITY.
WE DON'T HAVE ONE REPUBLICAN
VOICE IN WASHINGTON OF EVEN IF
YOU'RE DEMOCRAT, THAT SHOULD
BOTHER YOU.

AT THE END OF THE DAY, HE GAVE
COPE WITHO THE POLITICAL COVER
TO PASS SUCH A BILL BY
EXPRESSING HIS SUPPORT ALONG
WITH ALEXANDRIA OCASIO-CORTEZ.

WHEN YOU LOOK AT MY PROPERTY TAX
BILL, FOR EXAMPLE, A HOME THAT'S
VALUED AT $600,000, PAYING
$6,200.
YOU LOOK AT MAYOR de BLASIO'S
HOME, TRIPLE THE VALUE.
1.7 AND $1.9 MILLION.
HE HAS TWO HOMES IN PARK SLOPE.
HE'S PAYING 2,000 LESS IN TAXES.
HOW DOES THAT MAKE SENSE?
SO WE'VE BEEN PUSHING FOR THIS.
AND MIDDLE
INCOME COMMUNITIES IN OUR CITY
ARE DISPROPORTIONATELY AFFECTED.
IN ESSENCE, THEY ARE SUBSIDIZING
THE MOST EXPENSIVE PROPERTIES IN
OUR CITY.
WE'VE BEEN PUSHING THE MAYOR,
AND THAT WAS ONE OF THE ISSUES I
BROUGHT UP IN THE MAYOR'S RACE.
IF THEY HAD BROUGHT THAT UP MORE
THAN PRESIDENT TRUMP, BUT WE DID
GET A PROPERTY TAX COMMISSION.
THE MAYOR ANNOUNCED HE WOULD
RELEASE A REPORT TO FIX THIS.
THAT WAS DUE IN DECEMBER.
HE PUSHED THE GOAL POST.
