METROFOCUS: FEBRUARY 5, 2020

Criminal justice reform activists say that New York’s new bail reform law was long overdue. But critics argue that it has gone too far. One of its most vocal opponents, New York Assemblywoman Nicole Malliotakis, says that, “if it doesn’t get fixed, there’s going to be blood on Governor Cuomo’s hands.” She’ll share her take on the controversial legislation and discuss her efforts to unseat Democratic Congressman Max Rose.

CRIMINAL JUSTICE REFORM ACTIVISTS SAY THE NEW BAIL REFORM LAW WAS LONG OVERDUE.

BUT CRITICS ARGUE IT HAS GONE TOO FAR.

ONE OF ITS MOST VOCAL CRITICS SAYS THAT, QUOTE, IF IT DOESN'T GET FIXED, THERE WILL BE BLOOD ON GOVERNOR CUOMO'S HANDS.

SHE'S HERE TO GIVE US HER TAKE ON THE CONTROVERSIAL LEGISLATION AND TO TALK ABOUT HER EFFORTS TO UNSEAT DEMOCRATIC CONGRESSMAN MAX ROSE.

THOSE STORIES AND MORE AS 'METROFOCUS' STARTS RIGHT NOW.

THIS IS 'METROFOCUS' WITH RAFAEL PI ROMAN, JACK FORD, AND JENNA FLANAGAN.

GOOD EVENING.

WELCOME TO 'METROFOCUS.'

NEW YORK STATE'S NEW BAIL REFOR THAT LAW HAS BEEN UNDER TOUGH SCRUTINY SINCE IT WAS IMPLEMENTED ON JANUARY 1st.

NYPD COMMISSIONER SHEA BELIEVES THAT IT IS REQUIRES THE RELEASE OF ALL SUSPECTS EXCEPT THOSE CHARGED WITH THE MOST VIOLENT SKRIMS RESPONSIBLE FOR A QUOTE, SIGNIFICANT UP TICK OF CRIME IN THE CITY.

ACCORDING TO THE COMMISSIONER, IN THE FIRST THREE WEEKS OF 2020, OVERALL CRIME INCIDENTS ROSE BY 11% INCLUDING A 32% INCREASE IN ROBBERIES, A 61% INCREASE IN CAR THEFTS, AND AN 18% INCREASE IN BURGLARIES COMPARED TO THE SAME PERIOD LAST YEAR.

NOW ALONG WITH A NUMBER OF OTHER LAW ENFORCEMENT OFFICIALS ACROSS THE STATE, HE HE IS CALLING FOR THE LAW TO BE AMENDED.

ONE IS TO DECIDE WHETHER OR NOT TO KEEP THEM BEHIND BARS.

A SYSTEM THAT CRITICS SAY HAS BEEN SUCCESSFULLY IMPLEMENTED IN NEW JERSEY AND OTHER STATES.

MANY CRIMINAL JUSTICE REFORM ADVOCATES ARGUE THAT GIVING JUDGES DISCRETION IS UNACCEPTABLE AND IT IS SIMPLY TOO EARLY TO DECLARE THE NEW LAW A FAILURE.

THE ASSEMBLY WOMAN WHO IS LOOKING TO UNSEAT MAX ROSE IN THE 11th CONGRESSIONAL DISTRICT IS ONE OF THE LAW'S MOST VOCAL OPPONENTS.

SHE JOINS US NOW TO TALK ABOUT THE NEW BAIL REFORM LAW.

WELCOME BACK TO THE PROGRAM.

GREAT TO BE WITH YOU.

IN A RECENT APPEARANCE ON THE TUCKER CARLSON SHOW YOU SAID --

THE PEOPLE OF NEW YORK KNOW IT'S WRONG.

THE DEMOCRATS KNOW IT'S WRONG.

THE GOVERNOR IS SAYING SOMETHING NEEDS TO BE DONE AND YET WE'RE HERE NOW THE SECOND WEEK OF SESSION AND NOBODY HAS DONE ANYTHING TO ADDRESS IT AND IT HAS BEEN US, THE REPUBLICANS, PUTTING FORWARD LEGISLATION FOR FIXES.

AND I HAVE TO TELL YOU, IF IT DOESN'T GET FIXED THERE WILL BE BLOOD ON GOVERNOR CUOMO'S HANDS.

DOES IT RISE TO THE LEVEL OF BLOOD ON THE GOVERNOR'S HANDS?

WE DID SEE SOMEONE ON THANKSGIVING WHO WAS RELEASED WITH NO BAIL, CAME BACK AND KILLED A 92-YEAR-OLD WOMAN ON THE STREETS OF QUEENS.

THAT'S ONE EXAMPLE WHEN DO YOU RELEASE PEOPLE WITHOUT BAIL, WHAT CAN HAPPEN IF THEY POSE A DANGER TO SOCIETY.

IN ROCKLAND COUNTY ON CHRISTMAS EVE, THERE WAS A YOUNG MOTHER OF THREE WHO WAS HIT BY A VEHICLE IN A FATAL HIT AND RUN.

SHE WAS KILLED, UNFORTUNATELY.

THIS WAS AN UNLICENSED DRIVER, FLED THE SCENE, HE WAS CAUGHT, ARRESTED AND RELEASED BACK ON TO THE STREET.

AND WE SAW A DRUNK DRIVER, SOMEBODY WHO HAD 12 CONVICTIONS, SIX FELONIES, SIX MISDEMEANORS, DIDN'T SHOW UP FOR COURT IN FIVE PREVIOUS CASES.

HE WAS ARRESTED FOR NOT COMPLYING WITH THE COURT ORDER INTERLOCK DEVICE.

HE WAS RELEASED, KILLED SOMEONE A COUPLE WEEKS LATER DRIVING DRUNK AND THEN WAS RELEASED AGAIN.

THAT IS PRETTY OUTRAGEOUS AND THAT IS WHAT THIS LAW ALLOWS.

THERE ARE A LOT OF FLAWS AND I THINK THERE IS A GOOD GOAL HERE OF ENSURING, NUMBER ONE, EVERYONE GETS THEIR PROTECTED RIGHT TO A SPEEDY TRIAL.

WE CAN ACHIEVE THAT.

WE DON'T HAVE TO JUST THROW OUT BAIL.

YOU CAN HAVE A NO CASH BAIL SYSTEM FOR FIRST TIME OFFENDERS, LOW LEVEL OFFENDERS.

SOME OF THE CRIMES RATHER DISTURBING.

VIOLENT CRIMES LIKE STRANGULATION, ASSAULT, AGGRAVATED ASSAULT OF A CHILD, SOME PROSTITUTION OF A CHILD, VEHICULAR MANSLAUGHTER, HOMICIDE, THESE ARE CRIMES THAT ARE ELIGIBLE FOR THIS.

AND I THINK THAT IS A MAJOR PROBLEM.

TO BE RELEASED WITH NO BAIL AND THAT IS A MAJOR ISSUE.

WHAT WE WANT TO SEE IS JUDICIAL DISCRETION RESTORED.

WE WANT TO ENSURE THAT DANGEROUSNESS IS CONSIDERED OF THE.

I WANT YOU TO LATER IN THE CONVERSATION, GIVE US YOUR BULLET POINTS OF REFORMS THAT WOULD YOU LIKE TO SEE.

LET'S STAY ON THIS FOR ONE SECOND OF THE AS YOU KNOW, IN THE DECADES BEFORE THIS NEW LAW WENT INTO EFFECT, JUDGES HAD THE DISCRETION OF LETTING BAIL ANYW.

AND THEY DID LET OUT THOUSANDS AND THOUSANDS OF PEOPLE OUT WITHOUT BAIL.

PEOPLE WHO HAD COMMITTED MISDEMEANORS, NONVIOLENT FELONIES AND EVEN VIOLENT FELONIES AND A LOT OF THEM WENT OUT COMMITTING VERY BAD CRIMES, VERY SIMILAR TO THE ONES YOU JUST DESCRIBED.

YET THOSE NEVER GOT THE LEVEL OF ATTENTION BY THE PRESS OR BY ELECTED OFFICIALS THAT THESE RECENT CASES DID.

I WONDER WHY.

I ACTUALLY HAD BEEN TALKING ABOUT THAT ISSUE BEFORE THE BAIL LAW HAD PASSED.

AND I THINK THAT'S AN ISSUE OF VERY LIBERAL JUDGES WHO ARE JUST RELEASING PEOPLE.

THAT'S UNFORTUNATE.

PEOPLE HAVE TO UNDERSTAND THAT THEY EITHER ELECT THOSE JUDGES.

ANY OF THEM ARE ELECTED TO THE CIVIL COURT AND THEN SIT ON CRIMINAL COURT OR THEIR IS APPOINTING THEM.

SO SOME OF THE EXAMPLES THAT WE'VE USED IN THE PAST, PEOPLE BEING RELEASED, THEY WERE APPOINTED BY MAYOR de BLASIO.

IN SOME CASES HE'S REAPPOINTED THEM EVEN AFTER OUTRAGE.

THERE WERE CASES WHERE PEOPLE WHO THREATENED TO KILL POLICE OFFICERS WERE RELEASED WITHOUT BAIL.

AND THIS MAYOR CAME SXLAPG REAPPOINTED THEM.

OR THEY WERE ON THE BALLOT AND PEOPLE REELECTED THEM.

SO PEOPLE NEED TO PAY ATTENTION TO HOW THESE JUDGES AND OUR LEGISLATORS VOTE AND HOW THE JUDGES ACT ON SOME OF THESE CASES.

IF YOU DISAGREE WITH THAT, YOU NEED TO GET OUT TO THE POLLS.

I HEARD SOMEBODY STAY OTHER DAY, WE LOSE SIGHT OF THE FACT BAIL WAS NEVER INTENDED TO PUNISH ANYBODY.

IT WAS ALWAYS INTENDED SIMPLY TO MAKE SURE THAT DEFENDANTS SHOWED UP TO THEIR TRIALS BUT IT HAS BECOME IN ESSENCE, A VIOLATION OF THE ESSENTIAL BASIS OF OUR LEGAL SYSTEM, INNOCENT UNTIL PROVEN GUILTY.

THESE PEOPLE ARE IN JAIL BECAUSE THEY CAN'T MAKE THEIR BAIL BUT THEY'RE BEING PUNISHED FOR CRIMES THEY HAVE YET TO BE FOUND GUILTY OF.

THAT WAS I THINK THE GOAL AND INTENTION OF THIS LAW.

THEY WENT WAY TOO FAR AND THEY TOOK AWAY JUDICIAL DISCRETION, EVEN IN A SITUATION.

WE NEVER BASED ON IT DANGEROUSNESS.

WE ALWAYS BASED IT ON WHETHER YOU'RE RETURNING TO COURT.

OTHERS HAVE SAID, IF YOU ARE A DANGER TO SHOW.

IF YOU HAVE A CRIMINAL ACTIVITY OF VIOLENCE, YOU WON'T BE ELIGIBLE FOR SUCH A PROGRAM.

IF YOU ARE A FIRST TIME OFFENDER, A LOW LEVEL OFFENSE.

NONVIOLENT.

THAT'S SOMETHING THAT SHOULD BE CONSIDERED AND WE CAN ELIMINATE THE BAIL.

YOU WON'T DO IT FOR SOMEONE WHO HAS MULTIPLE CONVICTIONS.

24 PRIOR ARRESTS.

A PROTECTIVE POLICE OFFICER, RELEASED WITH NO BAIL.

BACK ON THE STREET AND IN SOME CASES, THEY'RE REARRESTED THE SAME WEEK.

SHOW THAT IS THE POINT THAT OUR POLICE COMMISSIONER WAS MAKING.

NUMBER ONE, PEOPLE WHO ARE REPEAT OFFENDERS IN THE SAME WEEK OR TWO WEEKS, COMMITTING MULTIPLE CRIMES AND BEING RERELEASED OVER AND OVER AGAIN.

THE OTHER ISSUE OF JUST MAKING SURE THAT THE PEOPLE ARE UNDERSTANDING THAT THIS IS NOT A FREE FOR ALL.

YOU CAN'T JUST, I THINK WHAT IS GOING ON IS THAT THE MAYOR AND THE GOVERNOR CREATE AN ENVIRONMENT OF LAWLESSNESS.

TO GIVE THE MAYOR'S DUE, DIDN'T HE FROM THE BEGINNING WANT THE REFORMS INCLUDE JUDICIAL DISCRETION?

I DON'T KNOW ABOUT FROM THE BEGINNING.

HE HAD SAID WE'LL GET PEOPLE METS TICKETS TO INCENTIVIZE THEM TO RETURN TO COURT.

THE GOVERNOR ACTUALLY DID.

HE DID IT BECAUSE HE WAS THE GOVERNOR WHO SIGNED IT.

GIVE THE MAYOR CREDIT.

EVEN HE IS SAYING, THIS TOOGS FAR AND SOME CHANGES NEED TO BE MADE.

THEY HAVE TO CONSIDER AN INDIVIDUAL'S PUBLIC SAFETY THREAT.

LET'S STAY ON THAT.

THAT'S THE WAY THE NEW JERSEY CRIMINAL JUSTICE SYSTEM REFORM LAW WORKED.

IN 2014, I THINK THERE'S BAIL FOR NO ONE NOW.

JUDGES DO HAVE DISCRETION AND THAT'S WHAT A LOT OF THE PEOPLE SAY IT SHOULD BE AMENDED TO.

BUT ADVOCATES OF JUDICIAL REFORM SAY THIS IS EXACTLY WHAT WE DON'T WANT.

TO ADD SUBJECTIVITY TO THE PROCESS.

BECAUSE THEY SAY IF PAST IS PROLOGUE, JUDGES WILL ATTEMPT TO SEE POOR PEOPLE, OF COLOR, BLACKS AND LATINOS AS AUTOMATICALLY MORE DANGEROUS BECAUSE THAT'S WHAT'S HAPPENED IN THE PAST.

HOW DO YOU RESPOND?

I THINK WE NEED TO TRUST OUR JUDGES AND GIVE THEM AUTHORITY.

THAT'S WHY WE HAVE SEPARATE BRANCHES OF GOVERNMENT, BUT NUMBER TWO, THERE ARE CERTAIN CASES THAT CAN BE PLACED IN THE LAW.

LIMITING THE TIMES OF CRIMES.

WE CAN TIGHTEN THIS LIST SO WE ELIMINATE ASSAULT AND AGGRAVATED ASSAULT, VEHICULAR MANSLAUGHTER, HOMICIDE, WE CAN REMOVE THAT WHICH IS CURRENTLY PART OF OPPORTUNITY TO BE RELEASED WITH NO BAIL.

WE CAN TIGHTEN THE LIST.

BUT YOU CAN ALSO SAY, LOOK, YOU'VE HAD MULTIPLE CONVICTIONS.

YOU HAVE A LENGTHY RAP SHEET.

THAT'S SOMETHING THAT SHOULD BE CONSIDERED.

AND THAT CAN BE TIGHTENED IN THE LAW.

SO IT IS ONLY UNDER CERTAIN SCENARIOS.

LET'S TALK ABOUT THE DISCOVERY THAT YOU MENTIONED.

THE RULES DEALING WITH EVIDENCE.

THE NEW LAW ALLOWS 15 DAYS WHERE THE D.A.s HAVE TO PROVIDE THE EVIDENCE, ALL THE EVIDENCE WITHIN 15 DAYS.

SOME PEOPLE SAY THAT'S NOT GOOD.

I THINK YOU AGREE.

TELL ME WHY.

IT IS NOT ENOUGH TIME TO COMPILE THE EVIDENCE.

IN SOME CASES, IF YOU'RE USING BODY CAM FOOTAGE FROM A POLICE OFFICER, ALL THOSE RECORDINGS HAVE TO BE PROVIDED.

IT IS NOT ENOUGH TIME AND A LOT OF CASES COULD BE THROWN OUT BECAUSE THEY DON'T HAVE THE MANPOWER, THE ABILITY TO COMPLY WITHIN 15 DAYS.

THAT IS A MAJOR ISSUE.

THE SECOND ISSUE IS WITNESSES TO PROVIDE WITNESS INFORMATION BEFORE YOU WOULD GIVE THE INFORMATION PRIOR TO A TRIAL.

IN SOME CASES THERE ARE PLEA DEALS.

SO YOU WOULDN'T HAVE TO PROVIDE THE INFORMATION.

SO THAT SHOULD BE A CONCERN.

ARE YOU REALLY GOING TO WANT TO NOW, MAYBE YOU'LL THINK TWICE ABOUT SAYING YOU SAW SOMETHING IF YOU KNOW THAT YOUR INFORMATION WILL BE HANDED OVER TO THE DEFENSE.

ASSEMBLY WOMAN, IF YOU LOOK AT THE POLLS, IT IS CLEAR THAT MORE AND MORE NEW YORKERS SHARE YOUR CONCERNS ABOUT THIS LAW AS IT STANDS.

I'M WONDERING IF THE CONVERSATION HAS LET US LOSE SIGHT OF THE FACT OF THE INJUSTICES.

THAT THE OLD SYSTEM POSSESSED, 60% OF 21,000 PEOPLE BEHIND BARS EVERY DAY ARE IN JAIL BECAUSE THEY CAN'T PAY BAIL.

THAT'S ALL PART OF THIS DISCUSSION.

WHAT WE HAVE ASKED WAS THE GOVERNOR RESCIND THIS LAW AND TED POWER TO DO IT BEFORE IT WENT INTO GO EFFECT.

ALLOW US TO HAVE PUBLIC HEARINGS, TO TAKE ON THE LEGAL COMMUNITY.

THE DISTRICT ATTORNEY'S INVESTIGATION WHO ARE ALL VERY OPPOSED TO THIS.

WHY THIS LAW IS SO DIFFICULT TO COMPLY WITH AND HOW IT MAKES US LESS SAFE.

WE CAN WORK THAT REFORMING THE BAIL SYSTEM BUT IT HAS TO BE DONE IN A COMMON SENSE WAY WHERE WE ARE LIMITING IT TO LOW LEVEL OFFENSES, FIRST TIME OFFENSES, RESTRICTING THE LIST OF CRIMES, ENSURING WE'RE PROTECTING WITNESSES, AND MORE IMPORTANTLY IN ACHIEVING THE GOAL THAT WE ENSURE EVERYONE GETS THEIR CONSTITUTIONALLY PROTECTED RIGHT TO A SPEEDY TRIAL WHICH THIS DOES NOTHING TO ADDRESS.

WE COULD BE INVESTING RESOURCES IN OUR COURT SYSTEM TO MAKE SURE THE CASES ARE HEARD QUICKER.

THEY NEED COURT OFFICERS, COURT REPORTERS, JUDGES TO DO THAT.

HOW WILL IT ALL PLAY OUT?

WHAT IS YOUR PREDICTION?

WILL THE GOVERNOR SAY LET'S DO IT?

ARE THE DEMOCRATS WHO VOTED FOR THIS GOING TO CHANGE THEIR MINDS AND SAY IT NEEDS TO BE AMENDED?

MANY OF MY COLLEAGUES AND I, AND WE'RE GAINING SUPPORT AS WELL FROM EVEN LEGISLATORS WHO VOTED FOR IT.

NOW SAYING THAT IT DOES GO TOO FAR.

AND THEY ARE SAYING THAT YOU KNOW, THEY'RE OPEN TO DISCUSSIONS.

I THINK IT IS VERY IMPORTANT.

THE GOVERNOR, IN HIS STATE BUDGET ADDRESS, SAID THAT HE'S OPEN TO CHANGES.

THAT HE BELIEVES SOME REFORMS NEED TO BE MADE.

THE MAYOR HAS COME OUT.

MEMBERS OF CONGRESS LIKE MY OPPONENT, MAFL ROSE, WHO WAS SUPPORTIVE OF THE BAIL REFORM IS TRYING TO BACKTRACK AS WELL.

WE'RE GAINING A LOT OF MOMENTUM IN GETTING PEOPLE WHO SUPPORTED THIS BAIL REFORM TO NOW REVERSE TRACK.

AND I THINK THAT IS CRITICAL.

WE CAN'T DO IT ALONE.

WE DON'T HAVE THE VOTES IN THE STATE LEGISLATURE.

WE NEED THE GOVERNOR TO SIGN OFF ON IT.

THE BIGGEST OBSTACLE IS THE SPEAKER.

I URGE PEOPLE TO GO TO MY WEBSITE.

I HAVE A PETITION THAT THEY CAN SIGN TO VOICE THEIR CONCERNS ABOUT THIS.

AND THEY CAN SIGN THE PETITION AND SAY, THEY SHOULD ALSO CALL THE GOVERNOR'S OFFICE AND STATE LEGISLATURE AND LET THEM KNOW.

WE HAVE TO CONTINUE THE PRESSURE.

I BELIEVE SOMETHING WILL BE ACHIEVED IN THE STATE BUDGET, WHICH I THINK IT IS A SHAME THEY'LL TRY TO SNEAK IT IN.

IT SHOULD BE TAKEN UP OUTSIDE THE BUDGET AND WE SHOULD HAVE HEARINGS ON IT AND IT SHOULD BE DONE PROPERLY.

BUT DO I BELIEVE SOMETHING WILL HAVE TO GET DONE.

THERE IS TOO MUCH PUBLIC OUTRAGE.

AND I THANK EVERYONE FOR WEIGHING IN ON THAT.

LET'S TURN TO THE CONGRESSIONAL RACE AND THE 11th CONGRESSIONAL DISTRICT.

YOU ARE ALREADY CAMPAIGNING AGAINST CONGRESSMAN MAX ROSE.

HE IS A DEMOCRAT.

THAT RACE IS IN NOVEMBER.

BEFORE THAT, YOU HAVE A PRIMARY.

YOU HAVE A REPUBLICAN, A FORMER PROSECUTOR, JOSEPH CALDERERA WHO IS RUNNING AGAINST YOU.

WHY ARE YOU CONFIDENT THAT YOU'LL BE IN THE NOVEMBER ELECTION?

I'M RUNNING MY RACE FOR NOVEMBER.

I'M TAKING ON MAX ROSE.

I'M THE INDIVIDUAL WHO HAS SHOWN THAT I HAVE STRENGTH IN THIS DISTRICT.

WE'VE ACHIEVED A LOT OF RESULTS, SAVING UP FOR OUR SENIORS AND VETERANS AND RESTORING BUS SERVICE.

HELPING MY CONSTITUENTS REBUILD AFTER HURRICANE SANDY.

I'M PROUD OF THE RELATIONSHIP I HAVE WITH MY DISTRICT AND I THINK THAT WE'LL BE SUCCESSFUL.

IT WILL WORK WITH THEM TO DO JOB THEY'RE ELECTED TO DO.

INFRASTRUCTURE.

FIGHTING THE OPIOID CRISIS.

BRINGING TRANSPORTATION FUNDING TO OUR CITY TO FIX OUR SUBWAY.

SO LET'S TALK ABOUT THAT CAMPAIGN.

YOU'VE OUTLINED A NUMBER OF THINGS YOU'RE RUNNING FOR.

WHAT HAS MAX ROSE DONE THAT HE NEEDS TO BE PUSHED OUT OF THE JOB FOR?

WELL, FIRST OF ALL, HE'S SOMEONE WHO SAID HE WOULDN'T SUPPORT IMPEACHMENT.

THEN TURNED AROUND AND VOTED FOR THE IMPEACHMENT.

HE SAID HE WOULDN'T SUPPORT NANCY PELOSI, THEN VOTES WITH HER 98% OF THE TIME.

HE RABBLE IN A DISTRICT HELD BY REPUBLICANS SINCE 1981 AND RAN AS A MODERATE.

NOW HE'S GOING TO WASHINGTON AND VOTING WITH ALEXANDRIA OCASIO-CORTEZ.

AND I THINK PEOPLE ARE LOOKING FOR SOMEONE WHO WILL GO TO WASHINGTON AND DO THE JOB THEY WERE ELECTED TO DO AND NOT TAKE PART IN ALL THIS PARTISAN BICKERING.

AND I THINK THAT'S REALLY WHAT IT COMES DOWN TO.

THIS DISTRICT IS ONE THAT, I GARNERED 67% OF THE VOTE IN THE MAYOR'S RACE.

THE PRESIDENT WON IT BY 10%. IT IS ONE IN WHICH YOU HAVE HARD WORKING TAXPAYERS THAT FEEL LIKE THEY'RE GETTING REALLY MISTREATED BY GOVERNMENT.

AND THEY WANT SOMEONE WHO WILL REPRESENT THEIR VALUES AND BE A COUNTER BALANCE, BY THE WAY, IN THE CITY.

WE DON'T HAVE ONE REPUBLICAN VOICE IN WASHINGTON OF EVEN IF YOU'RE DEMOCRAT, THAT SHOULD BOTHER YOU.

LET'S WRITE DOWN SOME OF THE THINGS YOU SAID.

TO CONGRESSMAN ROSE'S CLOSENESS TO SPEAKER PELOSI.

AS YOU KNOW, HE VOTED AGAINST SPEAKER PELOSI FOR SPEAKER.

THEN HE VOTED 98% OF THE TIME WITH HER SO WHAT'S THE DIFFERENCE?

BUT IN A VERY IMPORTANT VOTE, HE DID NOT SUPPORT HER.

THAT'S A SYMBOLIC VOTE.

YOU GET A PASS ON THAT.

LET ME FINISH THE QUESTION.

THE QUESTION IS THIS.

NANCY PELOSI WANTED A PASS TO THE RESOLUTION WHICH WOULD HAVE LIMITED PRESIDENT TRUMP FROM DOING ACTIONS LIKE HE DID, KILLING THE IRANIAN GENERAL WHO IS RESPONSIBLE FOR A LOT OF DEATH OF AMERICAN SOLDIERS AND MARINES.

AND HE HIMSELF SUPPORTED THAT ACTION.

AND HE PUBLICLY CHASTISED THE SPEAKER FOR WANTING TO ENTER SXREEN INTERFERE WITH THE PRESIDENT'S POWER TO DO SUCH A THING.

THAT SHOWS SOME INDEPENDENCE, NO?

ON MSNBC, HE HAD ACTUALLY QUESTIONED THE INTELLIGENCE THAT THE PRESIDENT MADE THAT DECISION OFF OF.

AND THEN ON FOX NEWS HE SAID SOMETHING ELSE.

SO THAT'S THE PROBLEM.

YOU SAY ONE THING IN THE DISTRICT.

SOMETHING ELSE IN WASHINGTON.

ONE THING ON FOX NEWS.

ONE THING ON MSNBC.

I THINK IT IS A MAJOR ISSUE.

I THINK THE BOTTOM LINE IS, IT'S OKAY.

I DON'T EXPECT EVERYONE TO VOTE WITH -- OF COURSE YOU WON'T VOTE WITH LEADERSHIP 100% OF THE TIME BUT 98% IS PRETTY HIGH, PARTICULARLY WHEN YOU RAN ON SAYING YOU WOULDN'T SUPPORT NANCY PELOSI.

HE WAS A SUPPORTER OF THE BAIL REFORM LAW IN NOVEMBER OF LAST YEAR.

HE ADDED HIS NAME TO A LETTER THAT INCLUDED FIVE REPUBLICANS.

A LETTER TO THE GOVERNOR ATTACKING, OR CRITICIZING THE LAW, IN THE SAME WAYS THAT YOU DO.

THAT WAS JUST A COUPLE WEEKS AGO THAT THIS HAPPENED.

THAT WAS AFTER WE HAD ALREADY BEEN THROUGHOUT TALKING ABOUT THE FLAWS OF THIS BILL.

THAT'S WHY HE'S DOING IT.

YOU NEED SOMETHING TO COVER HIMSELF.

HE HAD PUT DOWN IN A QUESTIONNAIRE THAT HE SUPPORTED QUOEMO'S BAIL LAW.

IT WAS A LINK TO THE BAIL LAW.

HE SAID I SUPPORTED MAYOR de BLASIO'S LAW TO CLOSE RIKERS ISLAND.

THESE ARE ISSUES VERY OUT OF SYNC WITH THE PEOPLE OF THE DISTRICT IN STATEN ISLAND AND SOUTHERN BROOKLYN.

SO HE CAN TRY TO FLIP-FLOP AND BACKTRACK AND THAT'S FINE.

AT THE END OF THE DAY, HE GAVE COPE WITHO THE POLITICAL COVER TO PASS SUCH A BILL BY EXPRESSING HIS SUPPORT ALONG WITH ALEXANDRIA OCASIO-CORTEZ.

I GOT TO INTERVIEW CONGRESSMAN ROSE.

AND THEM WHOLE INTERVIEW WAS HIM CRITICIZING THE SO-CALLED SQUAD.

HIM CRITICIZING THE GREEN NEW DEAL.

AND AS YOU KNOW, ALEXANDRIA OCASIO-CORTEZ HAS THREATENED, DID THREATEN IN THE PAST TO PUT SOMEBODY TO RUN AGAINST CONGRESSMAN MAX --

THAT'S WHY HE VOTED FOR THE IMPEACHMENT.

HE WAS OPPOSED TO IT.

THEN THE DAY AFTER GOT SOMEBODY WHO ANNOUNCED HE WOULD RUN.

WITHIN 24FLIPPED AND SAID HE WANTED IT.

AT THE END OF THE DAY, THOSE VOTES ARE JUST NOT REPRESENTATIVE OF THIS DISTRICT.

ONE OF THE REASONS WHY EXPERTS ARE CALLING THE RACE AGAINST MAX ROSA TOSS-UP, EVEN THOUGH HE IS THE INCUMBENT, BECAUSE YOUR DISTRICT WENT FOR DONALD TRUMP BY ALMOST 9 POINTS IN 2016.

BUT WHEN YOU WERE RUNNING FOR MAYOR IN 2017, YOU SAID THIS.

AND WE HAVE A CLIP ABOUT DONALD TRUMP.

YOU HAVE A CHOICE AND I WASN'T EXCITED ABOUT EITHER CHOICE.

SO I JUST VOTED FOR WHAT I THOUGHT WOULD SHAKE UP WASHINGTON.

MARCO WAS MY CHOICE AND I PROBABLY SHOULD HAVE JUST WRITTEN HIM IN.

NOW I HAVE TO ANSWER ALL THESE QUESTIONS ABOUT TRUMP WHEN I 97 REALLY ENDORSED HIM OR WAS OUT THERE CAMPAIGNING FOR HIM.

IT IS SORT OF DOGGING ME DOWN IN THIS CAMPAIGN EVEN THOUGH I WAS NEVER REALLY A SUPPORTER OF HIS.

WHAT IS TRUMP DOING WELL RIGHT NOW?

I DON'T KNOW.

I COULDN'T TELL YOU.

THE POLICY THAT'S HAVE COME OUT, I BELIEVE, ARE NOT GOOD POLICIES.

WHAT DO YOU THINK?

DO YOU STILL NOT SUPPORT TRUMP?

THAT WAS A FEW MONTHS INTO HIS ADMINISTRATION.

NOW YOU'RE LOOKING AT HIS ADMINISTRATION, YOU SEE THE GREAT THINGS THEY'RE DOING.

JUST YESTERDAY I WAS AT THE WHITE HOUSE AND WE WERE TALKING ABOUT THE U.S.-MEXICO-CANADA AGREEMENT.

HE SIGNED THE AGREEMENT HAD WILL BRING 176,000 JOBS TO THE UNITED STATES.

$60 BILLION IN ECONOMIC ACTIVITY.

THE LOWEST UNEMPLOYMENT AMONG AFRICAN-AMERICANS, WOMEN AND HISPANICS.

THESE ARE SIGNIFICANT ACHIEVEMENTS.

THERE'S A LOT THAT'S HAPPENED FROM TWO YEARS AGO.

MY POINT IN THAT INTERVIEW, WAS THAT MY ENTIRE RACE, WHEN I WAS POINTING OUT THE FLAWS AND FAILURES OF BILL de BLASIO, A TERRIBLE MAYOR, PERHAPS THE WORST IN THE ENTIRE WORD, EVERYBODY WANTED TO ASK ME ABOUT DONALD TRUMP.

IT WAS QUITE UNFAIR, ACTUALLY.

IT WAS QUITE UNFAIR.

EVERY POLICY PROPOSAL, EVERY PRESS CONFERENCE I HAD, I WAS ROLLING OUT IDEAS ON WHAT WE COULD DO BETTER.

ALL THEY WANTED TO DO WAS ASK ME ABOUT PRESIDENT TRUMP.

I THOUGHT THAT WAS QUITE UNFAIR CONSIDERING I HAD SUPPORTED MARCO RUBIO.

de BLASIO RAN AS IF HE WAS RUNNING AGAINST TRUMP.

HERE WE ARE TWO YEARS LATER, THE PRESIDENT HAS BEEN IN OFFICE THREE YEARS.

HE HAS SOME NOTABLE SUCCESS THAT'S I DON'T THINK ANYONE CAN ARGUE WITH.

SO I VOTED FOR ANYMORE 2016.

I'M GOING TO VOTE FOR HIM AGAIN.

IT MAKES PERFECT SENSE.

IT IS NOT ONLY UNFAIR THAT AT THE TIME EVERYBODY TALKED TO YOU ABOUT TRUMP.

NOW EVERYBODY IS TALKING TO YOU ABOUT THIS CLIP.

IT'S POLITICS, RIGHT?

THAT'S THE WAY IT IS.

YOU HAVE TO HAVE THE CONTEXT OF WHAT WAS DURING AT THAT TIME AND HOW I WAS CONTINUOUSLY BEING ASKED ABOUT PRESIDENT TRUMP DURING HIS FIRST FEW MONTHS IN OFFICE WHEN I WAS RUNNING AGAINST A FAILED MAYOR AND NO ONE WAS PAYING ATTENTION TO THOSE ISSUES THAT WERE VERY IMPORTANT BIFFLE THE WAY, THOSE ISSUES THAT I BROUGHT UP.

NYCHA, THE SUBWAY CRISIS, $750 MILLION WASTED, ALL THESE ISSUES.

THE PROPERTY TAX ISSUE.

NOW THEY'RE ALL IN THE HEADLINES.

I WAS TALKING ABOUT IT IN 2017.

NO ONE WANTED TO COVER IT.

MENTAL ILLNESS.

THAT WAS ONE OF THE BIGGEST PRESS CONFERENCES WITNESS A LIBERAL WHO RUNS THE MENTAL ILLNESS POLICY ALLIANCE.

HE WAS WILLING TO STAND WITH ME IN A BIPARTISAN FASHION.

WE PRESENTED A TREMENDOUS PLAN THAT WOULD HAVE ADDRESSED THE MENTAL ILLNESS CRISIS.

NOT ONE REPORTER COVERED IT OFTEN QUESTIONS ABOUT PRESIDENT TRUMP IN THE Q & A AFTER MY PRESS CONFERENCE.

OUR TIME IS ALMOST UP.

I HAVE TO ASK YOU.

YOUR COUNCILMAN HAS REVIVED THE IDEA OF STATEN ISLAND SECEDING FROM NEW YORK CITY.

30 YEARS AGO THAT WAS DONE.

WHAT DO YOU THINK ABOUT THAT IDEA?

I THINK IT IS AN IMPORTANT EXERCISE.

FOR ONE, WE HAVE HISTORICALLY SAID THAT STATEN ISLAND HAS BEEN SHORT CHANGED BY THE CITY OF NEW YORK WEST PAY MORE THAN WE'RE GETTING IN RETURN FROM THE CITY.

THAT IS EVIDENT.

WE'RE THE ONLY BURROUGH THAT DOESN'T HAVE A HOSPITAL.

IT IS SO INEQUITABINEQUITABLE.

STATTEN ISLAND RESIDENTS TRIPLE THE TAXES THAT BILL de BLASIO PAYS IN THAT BROOKLYN.

THERE IS A TALE OF TWO CITIES.

THE OUTER BURROUGHS VERSUS THOSE IN THE WEALTHIEST, MOST AFFLUENT COMMUNITIES OF OUR CITY.

SO I THINK THIS IS AN IMPORTANT EXERCISE TO BE CONDUCTING TO MAKE THAT POINT.

WHEN YOU LOOK AT MY PROPERTY TAX BILL, FOR EXAMPLE, A HOME THAT'S VALUED AT $600,000, PAYING $6,200.

YOU LOOK AT MAYOR de BLASIO'S HOME, TRIPLE THE VALUE.

1.7 AND $1.9 MILLION.

HE HAS TWO HOMES IN PARK SLOPE.

HE'S PAYING 2,000 LESS IN TAXES.

HOW DOES THAT MAKE SENSE?

SO WE'VE BEEN PUSHING FOR THIS.

AND MIDDLE INCOME COMMUNITIES IN OUR CITY ARE DISPROPORTIONATELY AFFECTED.

IN ESSENCE, THEY ARE SUBSIDIZING THE MOST EXPENSIVE PROPERTIES IN OUR CITY.

WE'VE BEEN PUSHING THE MAYOR, AND THAT WAS ONE OF THE ISSUES I BROUGHT UP IN THE MAYOR'S RACE.

IF THEY HAD BROUGHT THAT UP MORE THAN PRESIDENT TRUMP, BUT WE DID GET A PROPERTY TAX COMMISSION.

THE MAYOR ANNOUNCED HE WOULD RELEASE A REPORT TO FIX THIS.

THAT WAS DUE IN DECEMBER.

HE PUSHED THE GOAL POST.

IT IS UNLIKE REPLY STATTEN ISLAND WILL BE ABLE TO SUCCEED FROM NEW YORK CITY.

CAN YOU DO ANYTHING ABOUT THEM?

IT IS ABOUT MAKING SURE WE HAVE A VOICE THAT HAS A PLATFORM TO VOICE.

I'VE BEEN DOING A GOOD JOB FOR MY STWINTUSHIN SOME OF THE POLICIES.

WANTING TO PLACE HEROIN INJECTION CENTERS IN OUR CITY AND I'VE BEEN VERY VOCAL AND SUCCESSFUL IN PUTTING THOSE P PROPOSALS AT BAY.

I THINK IMPORTANT TO HAVE ONE VOICE OF OPPOSITION.

ALL RIGHT.

THANK YOU ONCE AGAIN FOR JOINING US.

GREAT TO BE WITH YOU.
