  • By submitting this form (your “Submission”), you represent, warrant, and agree that (i) the information you have provided is truthful to the best of your knowledge, (ii) THIRTEEN may share your Submission with its affiliates, WNET, WLIW, and PMNJ, and licensees including without limitation PBS (collectively, “WNET”), (iii) WNET may use your Submission, in whole or in part, in all manner and media, including but not limited in connection with The Great American Read (the “Project”), companion materials and ancillary platforms for the Project, and Project and institutional promotion and outreach, (iv) your Submission may be edited for brevity or inappropriate content, and (v) you possess or have obtained all rights necessary to grant the foregoing permissions – including without limitation privacy or publicity rights with respect to any individual(s) depicted in the Submission, and copyright in the Submission.

    In the event that you have submitted photos or other digital information (“User Generated Content”, or “UGC” for short) as part of your Submission, the UGC is governed by these terms and conditions, as well as the following:

    UGC Ownership. As between you and WNET, you are and will remain the owner of the UGC, and you represent, warrant and covenant to us that you own all right, title and interest, including copyright, in and to the UGC you submit or post to the Site and such UGC is truthful and accurate and shall not breach, infringe, contravene, or detrimentally affect any other party's rights whatsoever, including intellectual property rights, and that no other party has any rights to it including so-called "moral rights." In other words, you promise that no other company or person will claim that you stole or are inappropriately using the UGC.

    Our Right to Use the UGC. Although, as we explain above, you retain ownership of the UGC, by submitting, posting or displaying UGC you are automatically granting, and hereby do grant to WNET, a perpetual, worldwide, non-exclusive, fully transferable right and license to use (including the right to copy, display, perform, publish, modify, adapt and translate) such UGC in all forms and media (the "License"). This means that our right to possess, use and display the UGC anywhere and through any means will never expire, that we will never owe you any money for it and that we may allow others to use or possess the UGC.

    Right to Monitor and Editorial Control. You acknowledge and agree that WNET does not and cannot review all UGC submitted or posted to the Site and that you and/or others who post UGC are responsible for such content. Notwithstanding the foregoing, WNET reserves the right, but does not have an obligation, to monitor and/or review all materials posted to the Site or through the Site’s services or features by users. We reserve the right, at all times, to disclose any information as necessary to satisfy any law, regulation or government request, or to edit, refuse to post or to remove any information or materials, in whole or in part, that in our sole discretion are objectionable or in violation of these Terms and Conditions, WNET’s policies or applicable law. We may also impose limits on certain Features or restrict your access to part or all of the Features without notice or penalty if we believe you are in breach of the guidelines set forth in this paragraph, these Terms and Conditions or applicable law, or for any other reason without notice or liability.

    You further agree to indemnify, defend and hold WNET, its licensees and assigns, and the Project underwriters harmless from and against any and all claims, damages, costs and expenses, including reasonable attorneys’ fees and expenses, arising out of WNET’s use of your Submission and/or UGC in its broadcast, exhibition, distribution, exploitation, publication, promotion or other use of the Project as provided for in this Release and/or out of any breach or alleged breach of the foregoing warranty.
